DEP TO CHANGE OPEN BURNING RULE

The Florida Department of Environmental Protection (DEP) has issued a proposed rule that would change the terms "polyethylene black plastic mulch" and "polyethylene plastic mulch" to the term "polyethylene agricultural plastic" to be consistent with Florida’s existing open burning law.

After FFVA brought this issue to the attention of the Legislature’s Joint Administrative Procedures Committee (JAPC), which overlooks rules, JAPC then notified both the Florida Department of Agriculture and Consumer Services and DEP that they had adopted rules that were more stringent than the existing law.

“This is a positive thing for growers as it clarifies that all polyethylene agricultural plastic can be disposed of via open burning in accordance with the rules,” said FFVA Regulatory Affairs Manager Alan Peirce.
