ISSUE 1195

DHS FILES APPEAL IN NO-MATCH CASE AND REWRITES THE RULE
The Department of Homeland Security (DHS) recently filed a brief with the judge who issued a temporary restraining order prohibiting the DHS from enforcing the no-match rule in order to put the lawsuit on hold while it rewrites the rule. In addition, the DHS has appealed the judge’s ruling to the 9th Circuit Court of Appeals.

The District Court was asked to stay the rule until March 24, 2008 when DHS hopes to have written a new no-match rule that will address the problems outlined in the judge’s decision. Either way, DHS hopes to have the new no-match rule adopted and up and running by the spring of 2008.
