DEPARTMENT OF LABOR ANNOUNCES A 15-DAY EXTENSION FOR H-2A COMMENTS

The U.S. Department of Labor has announced that the comment period for proposed changes in the H-2A guest-worker program will be extended until April 14.

The Bush administration proposes streamlining some procedures, including replacing the current certification process with employer attestation, lengthening the time workers can stay in the United States after their employment has ended and shortening the time they must wait before gaining H-2A status again. It also would allow workers to extend their H-2A status and work temporarily for a different employer, provided that employer uses the E-Verify program.

FFVA’s Labor Relations Division is preparing extensive comments required for this complicated and sweeping proposal. Division Director Walter Kates said producer members should expect to receive communication about FFVA’s concerns over the proposal soon
