TRADE COMMISSION FINAL STATEMENT: DUMPING HURT FLORIDA GROWERS

Anti-dumping duties will be imposed on orange juice from Brazil, the U.S. International Trade Commission (USITC) has ruled. By a 3-3 vote, the commissioners made a final determination February 8 that the imports injured or threatened U.S. industry.

Under USITC rules, a tie vote gives an affirmative determination. U.S. imports of orange juice from Brazil amounted to more than $98 million in 2004, down from $158 million in 2003.

Imposition of anti-dumping duties requires final affirmative determinations both from the Department of Commerce that dumping occurred and from the USITC that the imports injured or threatened U.S. industry.
