ARIZONA APPEALS COURT AFFIRMS IMMIGRATION LAW

The 9th U.S. Circuit Court of Appeals in Arizona ruled Sept. 17 in favor of the Legal Arizona Workers Act, which says that the state may revoke a company’s licenses to do business if that company is found to knowingly hire illegal immigrants. Opponents of the Act say it violates employers' due process rights by denying them the chance to challenge allegations that their workers are illegal before their licenses are revoked.

The court ruled that federal law does not preempt the Act or its requirement that employers use an electronic verification system to check the work-authorization status of employees through federal record.
