HOW THE TPR PROCESS WORKS

1. The need for a particular chemical on a particular commodity must be assessed through a survey of all producer members of FFVA involved with production of that commodity.  Once the need for the label is verified, TPR signs a Registration and Indemnification Agreement with the manufacturer stating that the manufacturer will not be liable for crop loss, carry-over or non-performance issues associated with use of the product.  TPR then submits a request for a Special Local Need registration with supporting documentation to the Florida Department of Agriculture and Consumer Services.

2. Growers who wish to have access to the product are required to sign a Registration Agreement with TPR certifying the grower is an active producer member of FFVA and that the user agrees to pay an annual administrative charge of $2 per acre (if less than 125 acres are involved, a minimum charge of $250 applies).  The grower also must agree to adhere to all contents of the agreements.

3. The grower must sign a Waiver and Limitation of Warranty and Liability Agreement with TPR.  This agreement states that the grower accepts the liability associated with the use of the product and recognizes that the benefits outweigh any possible disadvantages associated with access to the product.  The location, acreage and name of the responsible party must be named on the waiver.  This agreement must be renewed annually to maintain an active participation.

4. The Grower submits payment for assessments to TPR along with the agreements.  Upon receiving payments and agreements, TPR executes the documents and provides the grower with the 24(c) label requested.  TPR provides the crop protection chemical distribution network with a current list of active growers who have legally acquired access to the 24(c) label. 

24(c) labels expire on July 31 of the current year.  Growers must renew the label to actively participate.   Labels will only be provided once the Waiver & Limitation of Warranty & Liability Agreement has been executed by TPR.
